ZAMNA VIP / UX EXPERIENCE

1. IDENTITY OF THE DATA CONTROLLER

Data Creativa, S.A. de C.V. (“Data Creativa”), as the entity responsible for the administration, processing, and safeguarding of personal data collected through the Zamna VIP / UX Experience project, makes this Privacy Policy available to all data subjects.

Data Creativa acts as the technology operator and database administrator for the project, in coordination with Zamna and the entities involved in providing services, experiences, events, and benefits associated with the program.

2. PERSONAL DATA COLLECTED

In order to register users for Zamna VIP / UX Experience, the following personal data may be collected:

Full name.
Email address.
Telephone and/or WhatsApp number, including country code.
City.
Country.
Preferred language.

The system may also collect and store information associated with the registration process, including:

Date and time of registration.
Event, city, or campaign from which the registration originated.
QR code or other registration method used.
Acquisition source or channel.
Consents granted by the user.
Version of the Privacy Policy and Terms and Conditions accepted by the user.

Sensitive personal data will not ordinarily be requested as a requirement for participation in the program.

3. PRIMARY PURPOSES OF DATA PROCESSING

Personal data may be processed for the following primary purposes:

Managing the user’s registration and profile.
Identifying and authenticating registrations.
Creating, maintaining, and administering the Zamna VIP / UX Experience database.
Preventing duplicate registrations.
Providing information requested by the user.
Managing benefits, access, experiences, presales, and services related to the program.
Responding to requests, inquiries, or support needs.
Maintaining the security and integrity of the platform and its associated systems.

4. SECONDARY AND MARKETING PURPOSES

Where the data subject has provided the corresponding consent, personal data may also be processed for the following purposes:

Sending information about upcoming Zamna events.
Communicating presales and early-access opportunities.
Sending promotions, benefits, and special offers.
Communicating VIP experiences and exclusive opportunities.
Sending newsletters and other informational content.
Sending communications by email and WhatsApp.
Personalizing content based on city, country, language, events, preferences, or interests.
Conducting statistical analysis, segmentation, and aggregated behavioral analysis.
Improving products, services, communications, and experiences within the Zamna ecosystem.

The data subject may withdraw consent to receive marketing and promotional communications at any time.

5. DATA SHARING AND TRANSFERS

In order to fulfill the purposes described in this Privacy Policy, Data Creativa may allow personal data to be processed by Zamna and other authorized entities participating in the operation of Zamna VIP / UX Experience.

Personal data may also be processed by technology and service providers necessary for the operation of the program, including providers of hosting, data storage, CRM systems, email services, messaging platforms, WhatsApp communications, analytics, cybersecurity, and related technological services.

Such service providers shall process personal data only for the applicable authorized purposes and shall be subject to appropriate confidentiality, privacy, and data protection obligations.

Where a transfer of personal data requires additional consent under applicable law, such consent will be obtained from the data subject as required.

6. DATA STORAGE AND SECURITY

Personal data will be stored in a centralized database technologically managed by Data Creativa.

Data Creativa will implement reasonable administrative, technical, and physical safeguards designed to protect personal data against loss, damage, alteration, destruction, unauthorized access, disclosure, use, or processing.

Access to personal data will be restricted to authorized personnel, service providers, and entities that require access in order to fulfill the purposes described in this Privacy Policy.

7. DATA RETENTION

Personal data will be retained for as long as reasonably necessary to fulfill the purposes for which it was collected and, thereafter, for any additional period required to comply with applicable legal, contractual, regulatory, or administrative obligations.

Once the applicable retention period has expired, personal data will be deleted, blocked, anonymized, or otherwise processed in accordance with applicable law.

8. DATA SUBJECT RIGHTS

Data subjects may exercise the rights available to them under applicable Mexican data protection law, including, where applicable, the rights of Access, Rectification, Cancellation, and Objection (ARCO Rights).

Data subjects may also request the withdrawal of their consent or request limitations on certain forms of processing where permitted by applicable law.

The request should contain sufficient information to identify the data subject, verify their identity where required, and clearly describe the right or request being exercised.

9. WITHDRAWAL OF MARKETING CONSENT

Data subjects may unsubscribe from commercial or promotional communications through the unsubscribe or opt-out mechanisms provided in the applicable email, WhatsApp message, or other communication channel, or by submitting a request to the privacy contact identified in this Privacy Policy.

Withdrawal of consent for marketing communications does not necessarily require the immediate deletion of personal data that Data Creativa is required or permitted to retain for legal, contractual, security, or regulatory purposes.

10. COOKIES AND SIMILAR TECHNOLOGIES

Websites, landing pages, and digital platforms associated with Zamna VIP / UX Experience may use cookies, pixels, tags, and similar technologies to enable platform functionality, measure traffic, analyze user interactions, improve the user experience, and, where permitted, personalize communications.

Where required by applicable law, users will be provided with mechanisms to manage their preferences regarding such technologies.

11. INTERNATIONAL DATA PROCESSING

Due to the international nature of Zamna and its events, certain technology providers, communication platforms, or infrastructure used in connection with Zamna VIP / UX Experience may be located outside Mexico.

Where personal data is processed or transferred internationally, Data Creativa will implement the contractual, organizational, technical, and security measures required under applicable law.

12. PRIVACY OF MINORS

The program is intended for individuals who have sufficient legal capacity to provide their personal data and grant the corresponding consents.

Where an event, service, or jurisdiction establishes specific age requirements or restrictions, the corresponding requirements shall apply.

Data Creativa does not intentionally seek to collect personal data from minors in violation of applicable law.

13. CHANGES TO THIS PRIVACY POLICY

Data Creativa may amend or update this Privacy Policy from time to time as a result of legal, regulatory, operational, technological, or commercial changes or changes to the Zamna VIP / UX Experience project.

The current version of this Privacy Policy will be made available through the digital channels enabled for Zamna VIP / UX Experience.

14. CONSENT

By providing personal data and acknowledging this Privacy Policy, the data subject confirms having been given access to and an opportunity to review this Privacy Policy.

Where consent is required under applicable law, the data subject expressly consents to the processing of personal data for the purposes described herein.

Consent for advertising, promotional materials, marketing communications, and similar secondary purposes may be requested separately.
